TERMS OF SERVICE

Your access and use of the Ruth Jones for Chandler Mayor website (the “Site”), and features provided by the Ruth Jones for Chandler Mayor Campaign (“Campaign,” “we,” “us,” or “our”) through the Site, excluding any software, products or services provided by the Campaign under a separate written agreement is subject to the terms and conditions in these Terms of Use (the “Terms” or “Agreement”). The Terms incorporate, by reference, all policies, notices and other content that appears on the Site. 

You must agree to the Terms in order to use the Site. If you use any aspect of the Site, we will understand this as your acceptance of and agreement to the Terms. By accepting the Terms or using the Site, you represent and warrant that you have the legal capacity to enter a contract in the jurisdiction where you reside. If you do not accept the Terms, then you may not use the Site. 

Updates to the Terms 

We may update the Terms at any time, and will post the updated version of the Terms on the Site. You understand and agree that you will be deemed to have accepted the updated Terms if you use any aspect of the Site after the updated Terms are posted. If at any point you do not agree to any portion of the Terms then you must immediately stop using the Site. 

Provision of the Site 

You are responsible for any internet connection and telecommunications fees and charges that you incur when accessing the Site. You acknowledge and agree that the Campaign may make changes to any aspect of the Site at any time without notifying you in advance. 

Payments and Refunds 

All currency references for the Site are in U.S. dollars. All contributions are payable in accordance with payment terms in effect at the time such contribution is made. The Campaign may, from time to time, modify, amend or supplement its donation processing procedures, and such changes shall be effective immediately upon posting a link to an update of the Terms or posting such changes elsewhere on the Site.  

Refunds are not available for donations, payments or gifts made through the Site. All transactions are final. However, the Campaign team may help research technical problems that may arise with transactions.  

Accepted Forms of Payment 

The Site supports most domestic credit, debit, prepaid or gift cards with a Visa, MasterCard, American Express, or Discover logo, and in some cases, direct debit (electronic checks) and PayPal. In addition, the Site supports most international cards with these logos. We may add or remove support for certain payment cards at any time without prior notice. We may elect only to process payment cards that receive an authorization from the applicable issuer. You agree to accept all of the payment cards listed in accordance with these Terms. 

Taxes 

Campaign donations are not tax deductible as charitable contributions for federal tax purposes.  

Links from the Site 

The Site may contain links to websites operated by other parties. The Campaign provides these links to other websites as a convenience and use of these websites is at your own risk. The linked websites are not under the control of Campaign and we are not responsible for the content available on the other websites. Such links do not imply our endorsement of information or material on any other website and the Campaign disclaims all liability with regard to your access to and use of such linked websites. 

Links to the Site 

Unless otherwise set forth in a written agreement between you and the Campaign, you must adhere to the following linking policy: (a) the appearance, position and other aspects of the link may not be such as to damage or dilute the goodwill associated with the Ruth Jones for Chandler Mayor Campaign; (b) the appearance, position and other attributes of the link may not create the false appearance that your organization or entity is sponsored by, affiliated with, or associated with the Campaign; and (c) when selected by a user, the link to the Site must display the Site on full-screen and not within a “frame” on the linking website, except as permitted by the Campaign. We reserve the right to revoke consent to the link at any time and in our sole discretion. 

Privacy Policy 

By accepting the Terms or using the Service, you represent that you have read and consent to our Privacy Policy (INSERT LINK “Privacy Policy”) in addition to the Terms. The Campaign may revise the Privacy Policy at any time, and a link to the new versions will be posted on the Site. If at any point you do not agree to any portion of the Privacy Policy, you must immediately stop using the Site. By using the Site, you agree to the then-current versions of the Terms and Privacy Policy. 

Location 

The Site is operated in the United States. If you choose to access the Site from a location outside of the United States, you do so on your own initiative and you are responsible for compliance with applicable local laws. 

Children 

The Site is not directed toward children under 13 years of age, and the Campaign does not knowingly collect information from children under 13 or allow them to donate using the Site. If you are under 13, please do not submit any personal information about yourself to the Site. 

General Disclaimer 

You understand and agree that your use of the Site is at your sole risk and that the Site is provided on an “as is” and “as available” basis without warranties or conditions of any kind, either express or implied. To the maximum extent permitted by applicable law, the Campaign expressly disclaims all warranties and conditions including, without limitation, warranties and conditions of satisfactory quality, merchantability, fitness for a particular purpose, non-infringement, and those arising from course of dealing or usage of trade. The Campaign does not represent or warrant that (a) you will be able to access or use the Site at the times or locations of your choosing; (b) that operation of the Site will be uninterrupted, timely, secure or error-free; (c) your use of the Site will meet your requirements; or (d) the Site is free of viruses or other harmful components. You acknowledge and agree that any material downloaded or otherwise obtained through the use of the Site is at your own risk and that you will be solely responsible for any damage to your computer, mobile phone or other device or any loss of data resulting from downloading or obtaining such material. 

Indemnification 

You agree to defend, indemnify and hold the Campaign harmless from and against any and all claims, demands, liabilities damages and losses including, without limitation, reasonable attorneys’ fees, resulting from or arising out of (a) your use of the Site; or (b) your breach of the Terms or any other policies that we may issue for the Site from time to time. 

Governing Law; Jurisdiction 

This Agreement is governed by Arizona law and applicable federal law (including the Federal Arbitration Act), without regard to conflict of laws principles. You and the Campaign agree that, the state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction of all disputes arising out of or related to the Terms or your use of the Site and agree to submit to the personal jurisdiction and venue of these courts. 

Terms Revisions 

The Terms may only be revised in a writing and published by the Campaign on the Site. 

Severability 

If any part of the Terms is determined to be invalid or unenforceable, then that portion shall be severed, and the remainder of the Terms shall be given full force and effect. 

No Waiver 

Our failure to enforce any provision of the Terms shall in no way be construed to be a present or future waiver of such provision, nor in any way affect our right to enforce the same provision at a later time. An express waiver by Anedot of any provision, condition or requirement of the Terms shall not be understood as a waiver of your obligation to comply with the same provision, condition or requirement at a later time. 

Notices 

All notices given by you or required under the Terms shall be in writing and sent to ruthjones4chandler.com

Entire Agreement 

The most current Terms, including the documents referenced in the Terms, constitutes the entire agreement between you and the Campaign with respect to the Site.
